1. Introduction

Welcome to ChartedTrail ("the Platform," "we," "us," or "our"). By uploading content, sharing travel experiences, and participating in any competition hosted on our Platform, you ("User," "you," or "Participant") agree to be bound by these Terms and Conditions.

2. Eligibility

Participation in competitions on ChartedTrail is open to individuals worldwide who:

  • Are at least 18 years old (or meet the legal age requirement in their country),
  • Have the legal capacity to enter binding agreements,
  • Provide accurate and truthful information.

We reserve the right to verify eligibility and disqualify any participant at our discretion.

3. Competition Participation

By uploading photos, videos, written travel descriptions, or other content ("User Content") and accepting these Terms, you are automatically entered into the competition.

It is at all times the sole responsibility of the Participant to provide accurate, complete, and up-to-date information in connection with competition participation, including but not limited to contact details and delivery information for prizes.

ChartedTrail is not responsible for failure to deliver prizes due to incorrect or incomplete information provided by the Participant.

Winners are selected based on criteria defined per competition (e.g., creativity, engagement, quality), and decisions made by ChartedTrail are final.

4. User Content and Ownership

By uploading or submitting any User Content on ChartedTrail, you:

  • Grant ChartedTrail a worldwide, irrevocable, perpetual, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works from your content.
  • Acknowledge and agree that ChartedTrail obtains full rights to use all uploaded content and associated information without limitation.
  • Confirm that this content may be used for marketing, promotional purposes, and across all media platforms, including but not limited to social media, advertising, and third-party partnerships.

You waive any rights to compensation, royalties, or attribution unless otherwise explicitly agreed in writing.

5. Representation and Warranties

By submitting content, you represent and warrant that:

  • You own or have full rights to all content you upload,
  • Your content does not infringe any third-party rights (including copyright, trademark, privacy, or publicity rights),
  • Your content is not unlawful, offensive, defamatory, or misleading,
  • Any individuals appearing in your content have given consent for its use,
  • All submitted content is original and created without the use of artificial intelligence (AI), including but not limited to AI-generated images, text, or enhancements.

6. Prohibited Content and AI Usage

Users may not upload or share content that:

  • Contains illegal, harmful, abusive, or discriminatory material,
  • Promotes violence, hate speech, or harassment,
  • Includes explicit or pornographic material,
  • Violates intellectual property rights,
  • Contains false or misleading travel information,
  • Has been generated, modified, or enhanced using any form of artificial intelligence (AI).

All submitted content may be subject to screening and analysis for AI usage.

ChartedTrail reserves the sole and exclusive right to determine whether content involves AI. Any such determination may result in immediate disqualification from the competition without notice or appeal.

7. GDPR and Data Protection

ChartedTrail complies with applicable data protection laws, including the General Data Protection Regulation (GDPR). By using the Platform, you acknowledge that:

  • Your personal data may be collected, processed, stored, and used globally,
  • Your data may be transferred outside your country of residence, including to countries without equivalent data protection laws,
  • ChartedTrail may use your data for platform functionality, marketing, analytics, and service improvement.

You have the right to request access, correction, or deletion of your personal data, subject to legal and operational limitations. You may exercise your GDPR rights or request information about your data at any time via the "Contact" page on the Platform.

8. Use of Personal Information

By participating, you consent to:

  • The use of your name, username, profile image, and submitted content for promotional purposes,

9. Prizes and Rewards

ChartedTrail reserves the right to:

  • Modify, substitute, or adjust prizes at any time without prior notice,
  • Offer alternative prizes of equal or lesser value where necessary.

Prizes may be subject to:

  • Taxes, duties, currency exchange fees, or other governmental charges depending on the winner's location,
  • Shipping costs, customs fees, or logistical limitations for physical prizes,
  • Restrictions or conditions imposed by third-party providers for gift cards, experiences, or non-cash rewards.

Any such costs, fees, or limitations are the sole responsibility of the winner unless otherwise explicitly stated. ChartedTrail is not responsible for delays, losses, or additional costs incurred during prize delivery or redemption.

10. Intellectual Property

All platform design, branding, technology, and content (excluding User Content) remain the exclusive property of ChartedTrail. You may not copy, reproduce, or exploit any part of the Platform without prior written consent.

11. Limitation of Liability

ChartedTrail is not responsible for:

  • Any loss, damage, or injury resulting from participation,
  • Technical issues, interruptions, or data loss,
  • User-generated content or interactions between users,
  • Issues related to prize delivery, third-party services, or external conditions.

Use of the Platform is at your own risk.

12. Indemnification

You agree to indemnify and hold ChartedTrail harmless from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Platform,
  • Your content,
  • Your violation of these Terms.
